Terms of Service

The agreement that governs your use of Nsawabode.

1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and Nsawabode ("Nsawabode", "we", "us"). By creating an account or using the Nsawabode app or website (the "Service"), you agree to these Terms. If you use the Service on behalf of a family, church, or organisation, you confirm that you are authorised to do so.

2. Accounts and eligibility

  • The Service is intended for families, churches, and organisations and their authorised team members in Ghana and neighbouring countries.

  • Client accounts use a verified phone number and password; one-time SMS codes support registration and password recovery. Privileged internal accounts use an email address or username and password, with an authenticator code where enabled.

  • You must provide accurate information, and you are responsible for activity under your account and for the team members you invite to your events.

3. The Service

Nsawabode is a funeral contribution service. The Digital Contribution Book is free and family-operated. It lets a family record contributors and amounts, view totals, and keep a digital record, but does not include a Nsawabode field team, managed Mobile Money, managed SMS acknowledgements, printed receipt operations, field equipment, or a kiosk.

The Professional Contribution Desk is a paid Managed Contribution Service. Essential, Professional, and Signature are service levels. Each paid booking applies to one specific confirmed funeral event or deployment and does not provide managed service for future events.

  • Essential is GHS 3,500, planned for up to 500 expected contributors and up to 6 service hours; managed Mobile Money is not included.

  • Professional is GHS 6,000, planned for up to 1,000 expected contributors and up to 8 service hours; managed Mobile Money is included.

  • Signature is GHS 12,000, planned for up to 2,500 expected contributors and up to 10 service hours; kiosk service is included only where confirmed and operationally available.

  • Contributor numbers are service-planning indicators, not a guarantee of attendance. Nsawabode sizes the field team according to expected volume, event conditions, and the confirmed scope; no exact officer count is promised unless quoted in writing.

4. Your responsibilities and data protection

  • Where you record contribution and contributor data, you are the data controller and Nsawabode acts as your processor on your instructions.

  • You confirm that you may record the contributor details you enter, and that you will use contributor phone numbers only to deliver receipts and event messages for that funeral.

  • You are responsible for the accuracy of the data you enter and for the content you publish on a memorial page.

  • You will use the Service in line with our Privacy Policy and applicable law, including the Data Protection Act, 2012 (Act 843).

5. Acceptable use

You agree not to:

  • Record fictitious contributions, or use the Service to mislead contributors or the family.

  • Attempt to access another family's data, breach security, or interfere with or overload the Service.

  • Publish unlawful, harmful, or offensive content on a memorial page.

  • Reverse-engineer, copy, or resell the Service except as the law expressly permits.

  • Use the Service to send unsolicited messages or to harass any person.

6. Receipts and reports

A Contribution Receipt confirms that the contribution shown was recorded for the specified funeral event. Contribution reports are prepared from event records. For physical cash, a receipt does not mean Nsawabode holds the cash: cash remains with the family or its designated cashier unless a separate written agreement expressly says otherwise. Review the final reconciliation summary and contribution handover promptly and raise discrepancies for investigation.

7. Fees

The Digital Contribution Book is free. Managed service fees are GHS 3,500 Essential, GHS 6,000 Professional, and GHS 12,000 Signature for one confirmed event. An extra Contribution Officer is GHS 450 per event day; an extra staffed station is GHS 750 per event day; overtime is GHS 350, GHS 500, or GHS 750 per hour respectively. Each additional ceremony day is 70% of the base package.

One-week observances, thanksgiving services, additional funeral days, multi-site work, and other extra deployments may incur additional charges. Travel and accommodation outside the standard service area are quoted separately. Events above 2,500 expected contributors and unusual or complex deployments require a custom quote. The booking summary shows the fixed base and add-ons before payment; a travel amount is not invented before quotation.

A 2.50% payer-borne contribution-processing fee applies to digital contributions. It is shown separately before payment, is not part of the family's contribution amount, and does not apply to the managed-service booking fee.

8. Cash, digital payments, settlement, and refunds

Physical cash remains in the family's custody. Digital contributions are processed by the stated payment provider. An initiated, pending, or processing payment is not confirmed; only provider confirmation records the contribution as confirmed. Failed, cancelled, expired, and refunded payments remain separately identified.

Provider, mobile-network, banking, review, or settlement delays may occur. Nsawabode does not promise an unverified settlement time. Refund availability and timing depend on the payment status, provider process, applicable law, and the verified circumstances; any approved refund is recorded separately from the family contribution total.

9. Cancellation and rescheduling

Plans change, especially around funerals. We treat a genuine postponement as a transfer rather than a cancellation when the family intends to use the confirmed Managed Contribution Service on another eligible date. Every new date remains subject to Nsawabode availability.

Rescheduling a managed service

  • One complimentary reschedule is available, subject to Nsawabode availability. With notice 7 or more days before the confirmed service date, one reschedule is permitted without a Nsawabode rescheduling fee.

  • Between 72 hours and 7 days before the confirmed service date, one reschedule is permitted. The customer remains responsible for genuine non-refundable third-party, travel, or operational expenses already incurred specifically for the booking.

  • Less than 72 hours before the confirmed service date, Nsawabode will prioritize transferring the booking rather than treating it as a cancellation. Genuine remobilization and non-refundable expenses already incurred specifically for the booking may be charged.

  • The complimentary reschedule applies once. Additional changes may be subject to a reasonable rescheduling or remobilization charge based on the actual operational impact.

  • A transferred booking remains valid for 90 days from the originally confirmed service date. After 90 days, Nsawabode may issue a new quote if prices or operational requirements have materially changed.

Customer cancellation refunds

  • Cancellations 7 or more days before service: 80% of the Nsawabode service fee is refundable.

  • Cancellations between 72 hours and 7 days before service: 50% is refundable.

  • Cancellations less than 72 hours before service: 25% is refundable.

  • After Nsawabode personnel or equipment have mobilized or arrived at the service location: no service-fee refund.

Actual non-refundable expenses already incurred specifically for the booking may be excluded from the refundable amount. These may include confirmed accommodation, non-refundable transportation, special equipment arrangements, and approved third-party service charges. Only genuinely incurred amounts may be retained; Nsawabode will not add arbitrary administrative charges disguised as expenses.

If a payment processor has charged a fee that is genuinely non-refundable, that processor charge may be excluded only where legally and contractually permitted and supported by the provider's actual policy. Nsawabode does not assume every Paystack charge is non-refundable. This is separate from the 2.50% digital-contribution processing fee.

If Nsawabode cannot provide the service

If Nsawabode cannot provide the confirmed service for reasons within its responsibility, you choose either a 100% service-fee refund or a reschedule. Nsawabode will not force store credit.

Additional ceremonies and events outside reasonable control

Each additional ceremony or deployment is treated as its own booked service for cancellation and rescheduling. If one deployment proceeds and another is postponed, only the affected deployment transfers or is assessed for cancellation.

If severe weather, emergency restrictions, civil disruption, government restrictions, major infrastructure failure, or another event outside either party's reasonable control makes delivery unsafe or impossible, both parties will first seek a reasonable reschedule. This provision is not a blanket right for Nsawabode to retain money without attempting to provide the service later; any unresolved refund is assessed under this section and applicable law.

10. Intellectual property and your data

We own the Service and all related software and materials. You keep ownership of the contribution and event data you put into the Service. You grant us a limited licence to host and process that data solely to provide and support the Service, as described in our Privacy Policy.

11. Third-party services

The Service relies on third parties, including our SMS gateway, Mobile Money payment provider, and hosting providers. Their availability is outside our control, and your use of features that depend on them is also subject to their terms.

12. Availability and changes

We work to keep the Service reliable but provide it on an “as is” and “as available” basis. We may update, change, or discontinue features, and we may carry out maintenance that temporarily affects availability.

13. Suspension and termination

We may suspend or terminate access if these Terms are breached or to protect the Service or its users. You may stop using the Service and delete your account at any time (see our Account & Data Deletion page). Deleting your account does not automatically erase records you controlled as a family or organizer; contact us if you also want those deleted.

14. Disclaimers

To the maximum extent permitted by law, we disclaim all warranties not expressly stated here, including fitness for a particular purpose and uninterrupted or error-free operation. The Service supports, but does not replace, the family's own record-keeping and judgement.

15. Limitation of liability

To the maximum extent permitted by law, Nsawabode will not be liable for indirect, incidental, or consequential losses, or for loss of data or funds not in our custody, arising from your use of the Service. Our total liability for any claim is limited to the fees you paid us for the event concerned. Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Indemnity

You agree to indemnify Nsawabode against claims arising from your misuse of the Service, your processing of personal data without a lawful basis or required consent, or content you publish on a memorial page.

17. Governing law

These Terms are governed by the laws of the Republic of Ghana, and disputes are subject to the jurisdiction of the courts of Ghana.

18. Changes to these terms

We may update these Terms from time to time. The effective date above shows when they last changed, and continued use of the Service after a change means you accept the updated Terms.
