Terms of Service
The agreement that governs your use of Nsawabode.

These Terms of Service ("Terms") are a binding agreement between you and Nsawabode ("Nsawabode", "we", "us"). By creating an account or using the Nsawabode app or website (the "Service"), you agree to these Terms. If you use the Service on behalf of a family, church, or organisation, you confirm that you are authorised to do so.
2. Accounts and eligibility
The Service is intended for families, churches, and organisations and their authorised team members in Ghana and neighbouring countries.
Accounts are verified by a one-time code sent to your phone. Keep your phone and account secure, and tell us promptly if you suspect unauthorised access.
You must provide accurate information, and you are responsible for activity under your account and for the team members you invite to your events.
3. The Service
Nsawabode helps families record funeral contributions and give every donor an official receipt. Contributions are recorded digitally at the venue, each donor receives an SMS receipt, the family sees live totals, and a final contribution report is produced. The Service is offered two ways: a self-serve app you run with your own team, and full-service packages where trained Nsawabode agents attend with POS terminals.
Nsawabode records and receipts contributions. Unless expressly agreed in a full-service package, physical cash remains in the custody of the family or organizer at all times, and Nsawabode is not a party to, and does not take custody of, those funds.
4. Your responsibilities and data protection
Where you record contribution and donor data, you are the data controller and Nsawabode acts as your processor on your instructions.
You confirm that you may record the donor details you enter, and that you will use donor phone numbers only to deliver receipts and event messages for that funeral.
You are responsible for the accuracy of the data you enter and for the content you publish on a memorial page.
You will use the Service in line with our Privacy Policy and applicable law, including the Data Protection Act, 2012 (Act 843).
5. Acceptable use
You agree not to:
Record fictitious contributions, or use the Service to mislead donors or the family.
Attempt to access another family's data, breach security, or interfere with or overload the Service.
Publish unlawful, harmful, or offensive content on a memorial page.
Reverse-engineer, copy, or resell the Service except as the law expressly permits.
Use the Service to send unsolicited messages or to harass any person.
6. Receipts and reports
A receipt issued by Nsawabode confirms that a contribution was recorded on the platform for a named donor and event. Contribution reports are prepared from the records entered at the event. Please review reports promptly and raise any discrepancy with us so it can be investigated and corrected. Receipts and reports are records of what was entered; they do not by themselves transfer or hold funds.
7. Fees
Creating an account and recording contributions in the app is currently free to start. Full-service packages are charged as a one-time fee per funeral event, confirmed when we contact you, and are shown before you commit. We may introduce or change fees in future and will give reasonable notice before any new charge applies to you.
8. Intellectual property and your data
We own the Service and all related software and materials. You keep ownership of the contribution and event data you put into the Service. You grant us a limited licence to host and process that data solely to provide and support the Service, as described in our Privacy Policy.
9. Third-party services
The Service relies on third parties, including our SMS gateway and hosting providers. Their availability is outside our control, and your use of features that depend on them is also subject to their terms.
10. Availability and changes
We work to keep the Service reliable but provide it on an “as is” and “as available” basis. We may update, change, or discontinue features, and we may carry out maintenance that temporarily affects availability.
11. Suspension and termination
We may suspend or terminate access if these Terms are breached or to protect the Service or its users. You may stop using the Service and delete your account at any time (see our Account & Data Deletion page). Deleting your account does not automatically erase records you controlled as a family or organizer; contact us if you also want those deleted.
12. Disclaimers
To the maximum extent permitted by law, we disclaim all warranties not expressly stated here, including fitness for a particular purpose and uninterrupted or error-free operation. The Service supports, but does not replace, the family's own record-keeping and judgement.
13. Limitation of liability
To the maximum extent permitted by law, Nsawabode will not be liable for indirect, incidental, or consequential losses, or for loss of data or funds not in our custody, arising from your use of the Service. Our total liability for any claim is limited to the fees you paid us for the event concerned. Nothing in these Terms limits liability that cannot be limited under applicable law.
14. Indemnity
You agree to indemnify Nsawabode against claims arising from your misuse of the Service, your processing of personal data without a lawful basis or required consent, or content you publish on a memorial page.
15. Governing law
These Terms are governed by the laws of the Republic of Ghana, and disputes are subject to the jurisdiction of the courts of Ghana.
16. Changes to these terms
We may update these Terms from time to time. The effective date above shows when they last changed, and continued use of the Service after a change means you accept the updated Terms.
